The case of a Naperville man who was arrested on probable cause of phone harassment and possessing psychedelic mushrooms but released from custody is still under investigation, according to the Will County State’s Attorney’s Office.

It’s unclear why charges were not filed against David Degeneffe, 19. Charges were approved by assistant state’s attorney Mike Casson, according to a Naperville police report.

Carole Cheney, spokeswoman for the state's attorney's office, said the “matter is still being investigated.” When asked if charges would be filed, she said she couldn’t speculate.

“It’s still being investigated,” she said.

Degeneffe was arrested and jailed on Jan. 15. He was released from custody the same day.

The police report said officers responded to a Jan. 14 domestic incident involving a 54-year-old man and 53-year-old woman who are listed as victims.

Degeneffe allegedly threatened a person whose name was redacted in the report.

Officers then learned Degeneffe sent two people threatening text messages, causing one of them to believe he was on his way to their home to do physical harm, the report said.

The report said a person, whose name was redacted, claimed psychedelic mushrooms were found inside of a metal Spider-Man lunch box and that the drugs belonged to Degeneffe.

Degeneffe denied the drugs were his, the report said.

Police Cmdr. Mike Son failed to return a call Tuesday.
